It is extremely difficult to estimate the costs in advance of a matter, simply because so much depends on your instructions and the way in which others react. However, the information below does give an estimate of the costs you could incur in respect of your case.

All fees below are exclusive of VAT because we currently do not charge VAT but may need to do so in the future.

The fees below are also exclusive of other third- party payments such as Court fees and Counsel’s fees.

Divorce

In respect of cases that deal with divorce ( but not including work in relation to any associated matters such as financial and children matters) if you are to be the Petitioner to the divorce ( the person commencing proceedings) this firm is offers to undertake this work and deal with matters on your behalf on a fixed fee basis at the rate of £700. The fixed fee does not include work in relation to any of the following:

  • Payment of any Court fees (the Court fee for issuing a divorce petition and applying for decree absolute is £550)
  • If the other party defends the divorce
  • The cost of having to arrange for the other party to be personally served with the divorce papers if he/she does not acknowledge receiving them
  • Applying for an order for service other than by post
  • Representing you at any Court hearings
  • Enforcing an order for costs obtained against the other party
  • Amending any papers once they have been sent to Court
  • Any costs in relation to obtaining a certified copy of your marriage certificate (if you do not have the original)
  • Any cost in relation to translating your marriage certificate if it is not in English
  • Any advice in relation to children and finance issues.

If any of the above- mentioned excluded matters arise, you will be provided with a revised estimate to account for the additional costs.

If you are to be the Respondent in the divorce proceedings, we offer to undertake this work on your behalf on a fixed fee basis in the sum of £400. However, the fixed fee does not include work in relation to any of the following:

  • If you wish to defend the divorce
  • The costs of applying for decree absolute (if the other party does not make their application within their permitted timeframe)
  • Representing you at any Court hearings
  • Defending you in relation to any claim for costs which may be made against you by the other party
  • Any advice in relation to children and finance issues.

Financial matters during divorce including Financial Remedy Proceedings during the Court process.

Sometimes following separation, the parties reach agreement between themselves or via the mediation process and wish to instruct a solicitor to incorporate that agreement into a legally binding document. In these circumstances, we would estimate our costs in drafting a Consent Order and the other associated legal documents, advising you and corresponding with the other side and the Court are likely to be in the region of £550 to £850 There is also a Court fee of £50 for lodging the Consent Order.

I the parties cannot reach an agreement and we need to engage in financial disclosure and negotiations that lead to a settlement without issuing formal Court proceedings it is difficult to predict costs at the outset because every case has its own individual factors. However, as a brief guideline and on the basis that matters are settled promptly, we would estimate costs in the region of between £1500 to £3000.There will also be a Court fee of £50 to lodge the Consent Order with the Court.

If it is not possible to reach a financial agreement and Court proceedings need to be issued then we would estimate the cost up to and including representing you at a First Appointment hearing would be in the region of £3000 to £5000. There will also be a Court fee currently £255.

In the event that the matter proceeds to a Financial Dispute Resolution Appointment (second hearing) before a District Judge who will attempt to assist you in reaching an agreement, we would estimate costs to be in the region of £5000 to £8000. However, if the matter proceeds to a third and final hearing then costs could be in the region of £8000 to £15,000 or possibly higher depending on the complexity of the matter and on how many issues are in dispute.

We will keep you informed of costs as your case progresses. It is not possible to predict how a case may proceed from the outset. We may therefore be obliged to increase or decrease the estimates above, accordingly. The above are estimated guidelines.

Children Matters

If there is a break down between the parties in the arrangements for the children then it may be possible to resolve a dispute through negotiation. If we are instructed to deal with a dispute concerning children and are able to resolve that through negotiation, we would estimate the costs of that to be in the region of £500 to £1000. If a referral to mediation is made then those costs would be your responsibility between you and the mediator and not included in this estimate.

If it is not possible to reach an agreement and a Court application is issued under the Children Act 1989, we would estimate the costs up to and including arranging for you to be represented at the first hearing would be in the region of £1500 to £2500.There is also a Court fee currently £215.

If matters proceed to a second hearing called a Dispute Resolution Appointment, we would estimate costs to be in the region of £3000 to £5000. If we needed to proceed to a Final Hearing then costs could be in the region of £5000 to £10,000 depending on the complexity and the number of issues in dispute. However, we will keep you updated in relation to your costs as your case progresses. It is not possible to predict how a case will proceed from the outset and we may be required too increase or decrease our estimates accordingly.

Separation Agreements, Cohabitation Agreements and Trust Deeds

These agreements generally start at around £350 to £800 depending on their complexity and provided they are agreed promptly.

Pre-nuptial and Post-nuptial Agreements

These agreements generally start at around £750 to around £1,500 but costs can be higher or lower depending on the complexity of the agreement.

Landlord & Tenant Matters

Costs in these matters will depend on their complexity and will need to be assessed on a case by case basis. We will be happy to provide you with an estimate of costs once we have assessed your matter.
